Berkeley Burn Injury Attorney

Burn injuries are among the most complicated medical conditions to treat because they affect skin, muscle tissue, nerves, and bone underneath. Complications from burns also impact the body’s temperature, ability to regulate fluids, and dexterity. For victims of burn injuries, however, the physical and aesthetic implications may be the most devastating. Scarring and disfigurement may cause emotional and psychological harm that reaches far beyond the pain.

If your burn injuries are linked to another person’s negligence, you may have rights to recover compensation. At the Law Office of Scott Righthand, P.C., our Berkeley burn injury attorneys are dedicated to pursuing all legal remedies available under California law. We have experience fighting on behalf of burn injury victims, both in settlement negotiations with insurance companies and in court. Please contact our firm to set up a consultation with an attorney who can tell you more about your rights.

A Berkeley Burn Injury Attorney Puts Your Needs First

If you suffer burns in an accident that was not your fault, you must prove that the responsible party caused your injuries due to the failure to comply with a legal duty of care. This breach of duty may occur in connection with common negligence scenarios, such as:

  • Car accidents;
  • Truck crashes, especially when the trailer is carrying hazardous chemicals or materials;
  • Motorcycle, pedestrian, and bicycle accidents.
  • Dangerous conditions on the property, which may exist when the owner or occupier fails to repair the premises or does not inspect;
  • Defective products, particularly when the item ignites, explodes, or leaks substances that can cause chemical burns; and,
  • Many other circumstances that involve radiation, chemical, inhalation, thermal, or electrical burns.

Classifying Burn Injuries

Medical providers have developed a system for categorizing burn injuries by severity, which includes:

  • First-Degree: These burns are minor, affecting only the external layer of skin. An example of this type of burn to the epidermis is a sunburn. Skin presents as red and sensitive but will usually heal within three to five days without medical treatment.
  • Second-Degree: The severity of these burns depends upon the area and part of the body. A second-degree burn is classified as major if it affects an area two to three inches wide or impacts the hands, feet, groin, or joints. The level of penetration into the epidermis and dermis is also a consideration. Blisters and redness are common, and surgery may be necessary to repair damaged tissue.
  • Third-Degree: Extensive medical treatment is usually necessary for third-degree burns, which destroys the epidermis and dermis layer underneath. The pain may not be as severe since the victim does not experience sensation due to nerve tissue damage. Third-degree burns usually require numerous skin graft procedures, but permanent scarring and disfigurement often remain.
