ANSWERS TO COMMON PERSONAL INJURY QUESTIONS

In this section, we have compiled answers to some of the most commonly asked questions
regarding injuries and compensation.

DO I NEED AN ATTORNEY?

Yes! You should never have to face the California legal system alone. The laws governing injury-causing incidents in the state of California can be difficult to understand, but with the right attorney, you can potentially obtain the compensation that you deserve.

WHAT SHOULD I DO AFTER MY AUTO ACCIDENT?

Here is a list of essential actions you should take following your auto accident:

  • Stay at the scene. You never want to flee as it could be considered a hit and run.
  • Check on the other drivers and passengers to make sure that everyone is OK.
  • If there was serious property damage, injury, or death, contact the police.
  • Exchange all necessary information with the other drivers and passengers.
  • Take pictures of the scene of the accident, including injuries and property damage.
  • Talk to any witnesses to the accident and gather their contact information.
  • Get in touch with your insurance company about the accident.
  • Contact an experienced personal injury lawyer to represent your rights.
ARE THERE THINGS I SHOULD NOT DO AFTER MY ACCIDENTS?

Yes, there are certain things that you should refrain from doing because they could potentially hinder your case:

  • Never apologize for the crash or admit it was your fault.
  • Never talk to the other insurance company without your attorney.
  • Never accept the first settlement offer without talking to a lawyer.
HOW LONG WILL MY CASE TAKE?

Each case is different, and depending on the individuals involved, the type of injuries you sustained and other details of your case, the total amount of time can vary drastically. Often a case cannot be resolved until your injuries have been identified and your condition stabilized. A simple fracture case where injuries have improved may settle more quickly than catastrophic injury cases that require extensive litigation and expertise. Working with an attorney can give you a better idea of how long your specific case may take.

WILL I RECEIVE COMPENSATION?

We do not accept cases that we do not think we can win. Case value is something that differs depending upon both liability and injury features of each case. There is no set formula in this business. When you work with our firm, we will immediately take action to determine what your case may be worth and how much compensation may be available to you for your injuries and suffering. Each case is unique, but with the right attorney on your side, you may be able to obtain monetary compensation.

WHO IS AT FAULT FOR MY INJURIES?

Determining fault is a big undertaking, but at The Law Office of Scott Righthand, P.C., we are confident in our ability to aggressively pursue justice and ensure that the wrongful party is held accountable for your injuries. We will work with you, interview witnesses, and scrutinize police reports and insurance findings to help determine who is at fault. There are many occasions where it is necessary to retain experts to evaluate fault. Remember, even if the police report may assign blame to you, that decision may not be correct. Furthermore, the officer’s opinion may not be admissible as evidence in your case if it goes to trial.

WILL I NEED TO GO TO COURT?

Many personal injury cases are settled before they ever enter a courtroom; however, if your case does go to trial, The Law Office of Scott Righthand, P.C., will aggressively assert and protect your rights. We want to ensure that your case resolves, either by settlement or after trial, in a way that provides full case value to you and is a fair conclusion. We will not stop until we have done all we feel we can to obtain just compensation for you.

IS AN ATTORNEY EXPENSIVE?

If you work with us through case conclusion, you owe nothing for our services unless or until we obtain compensation for you. Following an injury, the last thing you may want to think about is paying high legal fees for an attorney. However, at The Law Office of Scott Righthand, P.C., we are proud to offer experienced, affordable representation on a contingency-fee basis. This means that you will not pay us a dime unless we obtain compensation for you.

DO I NEED TO SPEAK TO AN INSURANCE COMPANY?

Never speak to an insurance adjuster without first contacting an attorney! Most insurance companies are only looking out for their best interests and are not concerned with your well- being. In order to protect yourself and your rights, we encourage you to first speak with our firm. Do not give statements or agree to be recorded without first contacting our office.

WHAT ARE MY RIGHTS AFTER AN INJURY?

After sustaining an injury that was caused by another person’s negligence or wrongdoing, you have the right to an attorney and the right to compensation. The time period within which you may pursue your rights is variable. In some cases you must file a claim within six months of the day of injury. Some cases have one-year statutes of limitations and some have two-year statutes of limitations. Some limitations periods for children are longer, but do not delay contacting us. For many reasons, including the statutes of limitations, it is imperative to pursue your rights as soon after the injury as is possible.
