Uber Lyft And Other Rideshare Accidents

RIDESHARE: LYFT, SIDECAR, AND UBER ACCIDENT ATTORNEYS

HELPING YOU FILE A CLAIM FOR YOUR RIDESHARE AUTO ACCIDENT INJURIES

Every year, new and improved technological advances make our 21st-century world just a bit easier, simplifying our often chaotic lives. The ridesharing industry is one.

Uber, Lyft, Sidecar and other groundbreaking rideshare services have taken off, offering a much more streamlined service than traditional cab services. With a convenient app and a touch of the finger, drivers can book a ride to just about anywhere in a matter of seconds. But like many things in life, there are downsides: Auto accidents and pedestrian accidents are one downside. We also are beginning to see a number of sexual assaults arising out of rideshare activities. We expect our rideshare drivers to respect the fact that we may be impaired. That could be why we are not driving. Please do not hesitate to call our offices about these cases. We recognize they are personal and will treat them, as we do all of our cases, as highly privileged matters.

Many people have suffered injuries while riding with Uber, Lyft or other rideshares. Before doing anything or speaking to anyone, contacting an experienced attorney should be your first step. Call us for a free case evaluation.

OVER 35 YEARS HANDLING ACCIDENT CLAIMS FOR BAY AREA INJURED PARTIES

At The Law Office of Scott Righthand, P.C., our California lawyers have been handling many different car accident injury claims for individuals all throughout the San Francisco Bay Area for over three decades. We know the laws, procedures and compensation injured parties are entitled to receive. The same goes for ridesharing incidents.

Depending on the company, it may require you as a passenger to file a claim with your own carrier. But what if you do not have an auto policy? What if your auto insurance policy specifically excludes coverage for injuries incurred in a ride-hailing auto accident? In other situations, the company may cover your expenses, but how do you know what you’re entitled to?

Our team of lawyers has over 35 years of combined experience handling these specific matters. We know how insurance companies work, their tactics and settlement methods. We will fight to make sure you are compensated by the right party and with the right amount.

LET US HELP YOU.

If you’ve been injured in an Uber, Lyft or other ridesharing auto accident, contact our team before speaking to anyone about your claim. We can talk to you about the law and answer any questions you have.

FAQs About Uber, Lyft & Rideshare Accidents in California

Who pays for my injuries if my Uber or Lyft driver caused the accident?

When you are a passenger during an accepted ride, your injuries are covered by the rideshare company’s substantial commercial insurance policy. These policies typically provide at least $1 million in liability coverage.

Can I still get compensation if the at-fault driver was uninsured or fled the scene?

As a passenger, you are protected. Rideshare companies are required to carry significant Uninsured/Underinsured Motorist (UM/UIM) coverage. If you are injured by a driver with no insurance or a driver who commits a hit-and-run, we can file a claim against the rideshare company’s UM/UIM policy to cover your damages.

How can you prove my rideshare driver was being negligent?

We can subpoena the driver’s app data to identify distractions like interacting with the phone before the crash. We may also utilize police reports, accident reconstructionists and witness testimony to build a clear case showing how the driver’s unsafe actions caused your injuries.

Why is my driver's app status important for my claim?

A driver’s status on the app determines which insurance policy applies. If they are actively transporting a passenger or en route to a pickup, the rideshare company’s full $1 million policy is in effect. If they are logged in and waiting for a request, a lower level of company coverage applies. If they are offline, their personal insurance is the only source of coverage.

What if I was driving my own car and hit by an Uber driver?

You should be able to file a claim against the rideshare driver and their applicable insurance policy, which depends on the driver’s status. We can help you determine the correct party to pursue.
